This site (later called the “Site”) is published by the Les Cleias Company (then called the “Seller”) whose head office is located at 94 rue du Temple, 75003 Paris.

I. FIELD OF THE GENERAL CONDITIONS OF SALES (CGV)

The General Terms and Conditions of Sale (CGV), detailed below, apply to all product orders placed via the Site. These T&Cs may be modified or adapted at any time. Of course, the conditions applicable to an order are those in force on the day of its order. The "Customer", a natural and adult person, making the purchase on the site and acting for purposes which do not fall within the framework of his commercial, industrial, artisan or liberal activity, declares that he has become aware of the CGV and the Privacy Policy, And to join by check the box provided for this purpose, before the payment is implemented.

II. ACCESS TO THE SITE

The Site is an e-commerce site, accessible to all users of the Internet network, 24 hours a day, 7 days a week, except in the event of force majeure or during maintenance. The Seller cannot guarantee a perfect site, free of malfunctions, but will make every effort to correct malfunctions if necessary.

The Vendor cannot be held liable for damage resulting from the use of the Internet network (and more precisely of the Site), namely the loss of data, the intrusion of viruses or other involuntary problems.

III. PRODUCTS

The products offered for sale are those which appear on the Site on the day of the consultation of the Site by the customer. They are available while stocks last. The products offered also comply with the regulations in force related to their composition, so they comply with the safety and health of the consumer. These products are presented by descriptions giving their main technical characteristics (such as composition or size). The photographs illustrating the products are as faithful as possible, but do not spare some slight differences with the product concerned. The descriptions and photographs presenting the products have only an indicative and non-contractual value. Each natural stone being unique, the colors and shapes may vary slightly from the photos.

The responsibility of the Seller cannot be engaged in the case of an error in updating available stocks, a slight difference between the product and its photograph or an omission in the description. Nevertheless, the Seller undertakes to provide the most suitable solution to the Customer. For a product marked as available in error, the Seller will notify the Customer as soon as possible. In the event that the order has already been placed, and the product already paid for, a refund could be made to the Customer.

IV. PRICE AND PORT FEES

The prices indicated are in euros (€), all taxes included (TTC), therefore including the Value Added Tax (VAT) at the rate in force on the day of the order. A rate change will result in the immediate modification of the prices on the products offered. Shipping costs are not included in the price indicated and will be indicated during the validation of the order.

The Seller reserves the right to modify the prices of the products at any time, without notice. However, the prices applied will be the prices presented at the time of the order. In the event of a problem displaying the price or displaying incorrect prices, the Seller undertakes to inform the Customer as soon as possible and to cancel the item ordered if necessary, or to offer the Customer his refund if the order has already been placed.

The Seller retains full ownership of the products sold until full payment of the price including costs and taxes.

In mainland France, a flat-rate contribution to the shipping costs will be billed to the customer, in the amount of € 6.00 including tax for home delivery and € 4.50 including tax for delivery to the relay point. In Europe and Switzerland, these costs will be charged € 12.00 including tax for home delivery, in the overseas departments, they amount to € 15 including tax, and € 30 in the rest of the world. Shipping costs are offered from € 80 purchase in mainland France, € 180 in Europe, Switzerland and DOM TOM and € 250 in the rest of the world.

V. ORDERS

The placing of an order on the Site is conditional on the prior registration of the customer on the Site. To be able to place an order, the Customer must first register on the Site, by creating an account with valid information. The Customer will then receive an email confirming registration. Once registered, the customer must identify himself to make his purchases, track his orders or modify his personal information. The Customer must remember to update them regularly in order to avoid delivery errors or other possible problems. In no case shall the Seller be held responsible for the non-delivery of the products to the address indicated if it is related to an error of information transmitted by the customer.

The Customer may delete his account at any time.

The Customer must add all the desired products to the shopping cart, by clicking on the “Add to cart” button on the product sheet. On the basket page, the Customer may possibly modify his choices, by modifying the number of items desired or by reconsidering his choices by deleting items. The total price of the basket will be summarized at the end of the page, without including shipping costs.

Once the items have been added to the basket, the Customer must click on the "Order" tab to place the order. If it has not already been done, the Customer must log in (or register if he does not yet have an account) and select the delivery and billing addresses from the registered addresses or register new ones. The Customer can then choose the delivery method and the carrier. Shipping costs will be calculated and the total amount of the order will be displayed.

The Customer will finalize his order by proceeding to payment and accepting the T&Cs and the Privacy Policy. For details regarding payment, see 'VI. PAYMENT MODALITIES».

The Customer will receive a confirmation e-mail with the invoice (mentioning the products ordered, their prices, their quantities and the total amount of the purchase) after payment. This invoice will also be accessible in the “my account” section, once the Customer has logged into his account.

WE. PAYMENT MODALITIES AND SAFETY

Orders must be paid for in a single payment on the day the order is placed.
The possible payment methods are:

  • credit card (Visa, Mastercard or American Express)
  • and PayPal.

To pay by credit card, the customer must bring his card number, enter the name of the owner of the card, the expiration date of the same card and the corresponding cryptogram (the 3 digits on the back of the card).

No Customer bank details are recorded on the Site. The online payment solution is a Shopify solution and is completely secure

For Paypal, the Customer will be redirected to Paypal and must follow the instructions on the site.

VII. DELIVERY

Cleias deliver worldwide.

Orders are generally dispatched within 48 hours of receipt of payment.


The risks associated with transport are the responsibility of the Customer from the moment the items leave the premises of the company Les Cleias.

Delivery times vary depending on the carrier selected:

  • Colissimo: between 3 to 5 working days in France, between 4 and 8 days in Europe, Switzerland and the overseas departments and between 9 and 15 days in the rest of the world.
  • DHL: between 24 to 48 hours
  • Mondial Relay: between 3 to 5 working days in France.

Delivery times are given for information only and are the sole responsibility of the carriers. The Customer cannot break the sales contract maintained between him and the Seller for an exceeded delivery period, unless the latter still does not receive his order after 30 days after validation of the order. In this case only, the Customer may request a termination of the contract and be reimbursed.

If the Customer receives a damaged, torn or opened package, he must imperatively refuse the package and report the problem to the carrier and the Seller. In addition, the Customer must also ensure that the number of items delivered corresponds with the figures indicated on the invoice and, if not, he must notify the Seller, with all the necessary evidence (photography for example). The Seller will then proceed to a new shipment or a refund according to the Customer's choice.

VIII. RIGHT OF RETRACT (REFUNDS AND RETOURS)

Under Art. L121-20 of the Consumer Code, the customer has 14 days from the date of receipt of the order to exercise his right of withdrawal and return the products to the Seller without penalty, except the return costs, which remain the responsibility of the customer. After this period, the Seller reserves the right to refuse the return and refund.

Products purchased cannot be exchanged. The Seller offers the Customer to return the item in question and be reimbursed, then to place a new order online.

Before any return, the Customer has the obligation to notify the Seller of his intention. He must indicate his order number and the products for which he wishes to exercise his right of withdrawal in the return package. After the Seller's agreement, the items must be returned in their original condition, ie unworn, undamaged and with their label in their original packaging. Personalized products are not affected by the right of withdrawal, and therefore cannot be returned.

The return of products purchased on the Site is only by post at the following address: 94 rue du Temple 75003 PARIS. The Seller will first check the returned items before proceeding with the refund, depending on the compliance of the item, within 30 days after receiving the returned items.

In the event that one of our jewelry has been purchased in a physical store of a resseller, only the resseller will be able to process the return of your jewelry upon presentation of the cash ticket.

IX. GUARANTEE

Legal guarantee

The products supplied by the Seller all comply with the regulations in force in France and have performances compatible with non-professional users. These products benefit from the legal guarantee of conformity, provided for by articles 1641 and following of the Civil Code independently of the right of withdrawal, defined according to articles L. 217-4 and the Consumer Code.

Refunds can only be made to the credit card used during payment.

Commercial guarantee

The Customer has a period of one year to notify the Seller of a lack of conformity of the product purchased on the Site (defective, damaged). He will have to wait for the Seller's agreement before returning the defective products to him. A return slip will be sent to him by email. The Customer must return the product in question to the following address: Les Cleias – Service Clients Particuliers, 94 rue du Temple, 75003 PARIS.

As for products made of natural materials (stone, leather, etc.), since each piece is unique, it is normal to receive an item with a very slightly different appearance from that of the site photograph. These differences are not production defects.

Upon receipt of the defective product, a quality control will be carried out to confirm its defect. The defective jewel will either be fixed or exchanged and will be returned to the billing address unless there is a specific request. Defective jewelry that cannot be repaired will be kept by our after-sales service.

This credit will be usable on the Site within 6 months.

The Seller reserves the right to refuse reimbursement, repair or replacement of the products for the following reasons:

  • Natural wear of the product;
  • negligence or poor maintenance on the part of the Customer, such as breakage or loss of the jewel and one of its elements;
  • damage due to handling error, abusive or abnormal use, intentional or accidental physical modification, use for professional or commercial purposes;
  • visible defects and products damaged during transport, after delivery;
  • the interventions carried out on the jewel by any person not mandated by the After-Sales Service as well as the deteriorations resulting from such an intervention;
  • The takeover of a jewel offered during a promotional offer.

X. INTELLECTUAL PROPERTY

All elements appearing on the Site are protected by copyright. Among these protected elements, we can cite the logo, photographs, images, texts, underlying technology, brand, etc. The Site and the products sold there are part of the intellectual property of Les Cleias. Any reproduction or distribution, partial or not, without the Seller's authorization is strictly prohibited and may constitute an offense of counterfeiting, resulting in legal proceedings.

XI. PROCESS OF PERSONAL DATNEES

The Seller reserves the right to access the Customer's personal information. This information will be kept confidential and will not be disclosed to a third party or exploited. The Customer understands that this step is necessary for his request to be processed. Otherwise, the Seller could not ship the order correctly.

Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Internet user has a right of access, modification and deletion of information concerning him. XIII. ENTIRE AGREEMENT

The sale of products is subject to French law. Disputes related to the GCS (about its execution or its interpretation), which cannot be settled by amicable agreement, will be submitted to the competent court in accordance with the rules of jurisdiction of common law and consumer law.

The General Conditions of Sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.

These distance selling conditions are subject to French law. For any dispute or litigation, the French courts will have sole jurisdiction.
